Terms of Service

Last updated: 19 May 2026. By creating an account on memfog.com you agree to these terms.

1. The service

Memfog ("the Service") is a hosted memory store for AI coding agents, accessible at memfog.com, app.memfog.com, and dashboard.memfog.com. The source code is published under the Apache 2.0 license at github.com/vikasswaminh/agent-memory.

2. Beta status

Memfog is in public beta. The Service is currently provided free of charge and as-is. We reserve the right to change features, pricing, or availability without prior notice. Material changes will be announced via email at least 14 days in advance once the Service exits beta.

3. Your account

• You must be at least 16 years old to create an account.
• You are responsible for keeping your password and bearer tokens secure. Anyone with your token can read and write your events.
• One account per natural person. You may not create multiple accounts to evade rate limits.

4. Acceptable use

You agree not to use the Service to:

• Send unsolicited bulk messages, spam, or anything intended to harass another person.
• Store content you do not have the legal right to store (third-party copyrighted material, secrets belonging to another organisation, etc.).
• Probe, scan, or attempt to subvert the Service's authentication, rate-limiting, or other security controls beyond your own account.
• Use the Service to develop a competing product where your account exists primarily to scrape our infrastructure rather than store your own data.

We may suspend accounts that violate this section while we investigate, and terminate them if the violation is confirmed.

5. Your content

You retain ownership of every event you push to Memfog. By using the Service you grant us a limited license to store, process, transmit, and serve those events back to you and to your designated integrations. We never display them to anyone else or use them to train any model. See the Privacy policy.

6. Service availability

We aim for high availability but make no SLA guarantee during beta. Cloudflare's edge fronts the API and routinely runs at 99.99% uptime; the origin we control is a single VM. Plan accordingly — if your workflow cannot tolerate occasional downtime, use the desktop client in local-only mode and treat the cloud sync as a convenience.

7. Termination

You may delete your account at any time by emailing hello@memfog.com. We will wipe your row in users within 7 days; encrypted backups containing the data age out within 14 days after that.

We may terminate your account for violations of section 4, with notice where reasonable. On termination, your access ends and your data is deleted on the schedule above.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEMFOG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL — ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED ONE HUNDRED US DOLLARS (USD 100) OR THE FEES YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.

10. Changes to these terms

If we materially change these terms we will notify active accounts by email at least 14 days before the change takes effect. Continued use after that date constitutes acceptance.
